Terms of Service

Welcome to Manyou. These Terms of Service ("Terms") govern your access to and use of the Manyou mobile application and related services (the "App"), provided by Hello Juggler LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Eligibility and Age Requirement

The App is not intended for use by children under the age of 13. By using the App, you represent that you are at least 13 years of age. If you are between the ages of 13 and 18, you represent that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You specifically agree not to:

• Use the App to photograph or record artifacts, exhibits, or individuals where prohibited by the venue's rules or applicable law. It is your responsibility to respect venue photography policies before using the App in any location.
• Reverse engineer, decompile, or attempt to extract the source code or underlying AI models of the App.
• Attempt to bypass or manipulate the in-app purchase system, free-tier limits, or authentication mechanisms.
• Submit images that contain illegal, explicit, or highly sensitive personal content.
• Use the App in a way that could disable, overburden, or impair our servers or infrastructure.
• Engage in any abusive, fraudulent, or manipulative behavior, including but not limited to: artificially generating free content, submitting misleading or off-topic images to manipulate the system, or attempting to exploit the reward or contribution systems.

We reserve the right to flag, limit, suspend, or permanently terminate access for any user whose behavior we determine, in our sole discretion, to be abusive, fraudulent, or harmful to other users, our infrastructure, or the integrity of the App. This right applies to both anonymous and authenticated users.

3. Anonymous and Authenticated Users

Anonymous Use: You may use the App without creating an account. In anonymous mode, you are identified by a device-generated identifier stored locally on your device. This identifier is used to enforce usage limits, associate in-app purchases with your device, and maintain your usage history.

Account Creation: You may optionally create an authenticated account to enable cross-device access and account recovery.

Anonymous-to-Authenticated Transition: If you make in-app purchases while anonymous, those purchases are associated with your device identifier. You may claim these purchases to an authenticated account by completing account creation while on the same device.

Data Associated with Anonymous Users: Even in anonymous mode, we collect and store the device identifier, usage logs, uploaded images (subject to the license in Section 4), and purchase records. These are treated with the same privacy protections as authenticated user data and are subject to your right to deletion described in Section 9.

4. AI Data Processing Consent and License

Consent Before AI Processing: Before the App transmits any of your photos or personal data to a third-party AI service for the first time, the App presents an in-app disclosure screen that identifies:

• What data will be shared — photos you capture, venue location, and exhibit context.
• Who will receive it — Google and SpaceX for narrative generation; SpaceX, Google, or Fish Audio for audio, depending on the feature used.

You must affirmatively tap "Agree & Generate" for any AI-powered data sharing to occur. Choosing "Not Now" prevents your data from being sent to AI services, and AI-powered features will not be available until consent is given. You may withdraw consent at any time by contacting us at [email protected] or deleting your account within the App.

Your Ownership: You retain all rights and ownership to the original photos and images you take using the App.

License to Us: Upon giving your consent, you grant Hello Juggler LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, and store your images and related metadata to provide the core functionality of the App and improve our services. This includes, but is not limited to:

• Transmitting the images to third-party AI, machine learning, and text-to-speech service providers to generate audio narratives.
• Retaining the images on our cloud infrastructure to cache narratives for subsequent users.
• Using the images to train, test, and improve our product features, including future on-device image similarity matching models.

Your Content Representations: By submitting images through the App, you represent that you have the right to submit those images and that doing so does not infringe any third-party intellectual property rights. You are responsible for ensuring your submissions comply with applicable law and venue policies. We do not actively monitor submitted content for third-party IP compliance, but we reserve the right to remove any content upon notice or at our discretion. 5. AI Disclaimer and Content Accuracy

The narratives, descriptions, and audio provided by Manyou are generated using third-party artificial intelligence and text-to-speech models. By using the App, you acknowledge and agree that:

• No Guarantee of Accuracy: AI systems are prone to errors, hallucinations, and inaccuracies. The narratives provided are for entertainment and general informational purposes only.
• Not Professional Advice: The App's content should not be relied upon as authoritative historical, artistic, or academic fact.
• "As Is" Service: The content is provided "as is" and "as available" without warranties of any kind, either express or implied.

6. In-App Purchases and Accounts

• Purchases: We offer non-renewing access passes (e.g., 1-day or 1-week passes) via In-App Purchases (IAP) through the Apple App Store. All transactions are processed by Apple and are subject to their respective terms of service.
• Refunds: Because payments are processed by Apple, we cannot issue refunds directly. Any refund requests must be routed through Apple's customer support. However, if you contact us at [email protected] with your original transaction ID, we will make a best-effort attempt to restore access to any unexpired passes in the event of device loss or account transition. This is provided as a courtesy and is not guaranteed.
• Account Termination: We reserve the right to suspend or terminate your access to the App, including revoking any remaining unused passes, without notice or refund, for conduct that we determine violates these Terms, is abusive, or is harmful to other users, our systems, or third parties.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Hello Juggler LLC, its founder, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App.
• Any inaccuracies or errors in the AI-generated content.
• Any unauthorized access to our servers and/or any personal information stored therein.

Liability Cap: In no event shall our aggregate liability for all claims relating to the App exceed the greater of one hundred U.S. dollars ($100.00 USD) or the amount you paid us in the past twelve months for the services giving rise to the claim.

8. Dispute Resolution and Arbitration

Please read this section carefully, as it affects your legal rights.

• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
• Class Action Waiver: You and Hello Juggler LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

9. Your Data Rights and Deletion

Right to Delete: You have the right to delete your personal data associated with your account, including your device identifier, uploaded images, usage history, and purchase records. You can delete your account at any time directly within the App: open the account menu and choose Delete Account. No email request is required.

Processing Time: When you confirm deletion in the App, your account is queued for deletion immediately and processed within 30 days. Some data may be retained beyond this period where required by law or for legitimate business purposes (e.g., fraud prevention records or legally mandated transaction logs). If you are unable to use the in-App option, you may contact us at [email protected] for assistance.

Effect of Deletion: Deleting your data will remove your usage history and associated content from our systems. It does not entitle you to a refund of any in-app purchases, and it does not reverse Apple's own transaction records.

10. Governing Law and Jurisdiction

These Terms and any action related thereto will be governed by the laws of the State of California, United States, without regard to its conflict of laws provisions. For any actions not subject to arbitration, the exclusive jurisdiction and venue will be the state and federal courts located in California, and you waive any objection to jurisdiction and venue in such courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this document and, where reasonably practicable, by posting a notice in the App. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
